(Luis Cornelio, Headline USA) The DOJ has once again sought the intervention of a federal judge in their battle against former President Donald Trump, begging a gag order to block him from making statements regarding the 2020 election case.
According to the New York Times, prosecutors from the DOJ argued on Friday that Trump’s public comments constitute “a sustained campaign of prejudicial public statements” aimed at undermining the scandal-plagued DOJ and Special Counsel Jack Smith, but they skipped a major key factor.
The DOJ cited Trump’s recent remarks targeting outgoing Joint Chiefs head Gen. Milley as a prime example of why they believe a gag order is necessary. However, they failed to mention that Trump, who has long used his social media platforms to communicate with his voters, was merely responding to Milley’s attacks against him.
Milley, who has become a vocal critic of Trump, has been interviewed by various media outlets and is a key witness in the case. Speaking to the Atlantic on Sept. 21, Milley admitted to holding secret conversations with China in a bid to understand the duly elected president.
Reacting to those reports, Trump posted on Truth Social, saying, “This is an act so egregious that, in times gone by, the punishment would have been death!”
Biden’s prosecutor Molly Gaston argued, “No other criminal defendant would be permitted to issue public statements insinuating that a known witness in his case should be executed. This defendant should not be, either.” The prosecutor also used another Trump post where he touted a photo inside a gun store.
Even though Trump is Biden’s leading opponent, Gaston claimed that Trump does not deserve special treatment.
“He demands special treatment, asserting that because he is a political candidate, he should have free rein to publicly intimidate witnesses and malign the court, citizens of this district, and prosecutors,” she claimed in her plea to the judge. “But in this case, Donald J. Trump is a criminal defendant like any other.”
The initial request for a gag order was submitted in September 5, but Judge Tanya S. Chutkan, who has faced criticism from Trump in the past, has yet to rule on the matter, according to the New York Times.
